Legal Terms and Conditions

Disclaimer

EduMate NYC and its organizers act on a purely voluntary basis and do not receive any compensation for the services offered or provided herein. We rely on third party volunteers to provide tutoring services. We rely in good faith on the information tutors have provided us about their backgrounds, credentials, qualifications, abilities, and aptitudes, which we have not independently sought to verify. We do not guarantee any educational results. We have instructed our tutors not to seek in person contact with students, as well as to not record lessons with their students unless they have the express written permission of those students and their legal guardians. However, we do not monitor the interaction between tutors and students; this is a private interaction, and we rely upon the tutors to comport themselves appropriately within the bounds of our policies and any applicable law. If at any point, we determine that a tutor has violated our policies, the tutor will be removed from our program. Please let us know if you suspect or know of any such violations immediately.

Limitation of Liability

To the maximum extent permitted by law, EduMate NYC, its organizers, representatives, tutors, and agents will not be liable for any direct, incidental, special, consequential, punitive, or multiple damages, or loss of any kind, whether incurred directly or indirectly, resulting from your use of EduMate NYC, its services, or those provided tutors affiliated with EduMate NYC.

Choice of Law

Except to the extent they are preempted by U.S. federal law, the laws of New York, other than its conflict-of-laws principles, govern these Terms and any claims and disputes (whether contract, tort, or otherwise) arising out of or relating to these Terms or their subject matter.

Whether you are a tutor, student, family, or educational professional, we are glad to have you as part of our community at EduMate NYC (“we”, “us”, or “our”). We are committed to protecting your personal information and your right to privacy. When you visit our website edumatenyc.org, and use our services, you trust us with your personal information. We take your privacy very seriously. 1. What information do we collect?

We collect certain information from you (our volunteer tutors, our students and our students’ families) to conduct a variety of activities related to our objective of arranging matches between volunteer tutors and students in need of tutoring. We collect:

Information provided by you during signup. This information includes, but is not limited to: names, email addresses, phone numbers, academic needs, academic skills, and meal plan eligibility.

Information provided about you by other users. Volunteer tutors may provide us information about changes in students’ academic needs. Likewise, students and students’ families may provide us information about a volunteer tutor’s fit for them or for their student.

2. How do we use your information?

We use personal information collected from you:

To deliver services to you. We and/or the volunteer tutors may use your information to provide you with the requested service.

To communicate with you. We and/or the volunteer tutors may use the personal information you send to us for our communication purposes. You can opt-out of our outreach emails at any time.

To respond to your inquiries and to offer support. We and/or the volunteer tutors may use your information to respond to your inquiries and solve any potential issues you might have with the use of our services.

To request feedback. We and/or the volunteer tutors may use your information to request feedback and to contact you about your use of our services.

To improve our matching service. We and/or the volunteer tutors may use your information to identify usage trends, to evaluate and improve our services, and to evaluate and improve the effectiveness of our matching system and related outreach efforts.

To enforce our terms, conditions and policies.

3. Will your information be shared with anyone?

We will share your information with third parties:

To report on our service’s performance. In the event that we share general statistics about our service’s performance with third parties or with the public, no identifiable personal information will be included. We will only include your personal information in such reports if we receive your express written consent (or, if needed, the consent of your parent or guardian).

To perform other activities with your consent. We may process your data if you have given us specific consent to use your personal information for a specific purpose.

To fulfill legal obligations. We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, judicial proceedings, court orders, or other legal processes.

To protect student safety. If a student reports to EduMate NYC events or circumstances that involve a threat to their safety, EduMate NYC will convey those events or circumstances to the relevant agencies of New York State. As part of this reporting, EduMate NYC will provide the student’s personal information as necessary.

4. Do we use cookies and other tracking technologies?

We use third party partners to conduct a variety of activities related to our objective. These third parties may use cookies and other tracking technologies to maintain their respective services.

5. What rights do students’ parents and legal guardians have?

Students’ parents and legal guardians can email edumatenyc@gmail.com in order to:

Review the personal information collected from their child.

Revoke their consent and refuse the further use or collection of personal information from their child.

Request the deletion of their child’s information. See What are your privacy rights? for more information about the deletion process.

6. How long do we keep your information?

We keep your information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.

8. What are your privacy rights?

If you would at any time like to review or change the information we associate with you, please email us at edumatenyc+privacy@gmail.com. If you would like to unsubscribe from emails we send through third party marketing services, you may click the unsubscribe button at the bottom of those emails.

At your request, we can delete your information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, enforce our Terms of Service and/or comply with legal requirements.

9. Do we update this policy?

Yes. We may update this privacy policy from time to time to stay compliant with relevant laws, and to reflect any changes to our services. At such a time, we will change the “last updated” text at the bottom of this policy. Significant changes will also be communicated via email to our volunteer tutors, students, and students’ families.

Tutor Contract

I agree to abide by all the policies of EduMate NYC and assume full responsibility for all of my actions as an unpaid volunteer in this program. I recognize that if at any time I break any policy of EduMate NYC, I will be removed from the program and I will assume total liability for any consequences of my action. These policies include but are not limited to the following:

1. Tutors will not meet in person with their students at any point in the EduMate NYC program.

2. Tutors will not record any meeting with their students without the express and written permission of those students and their legal guardians in accordance with state law. Any recordings that are made will be made only at students’ request (with the permissions above granted and the express written consent of the tutor) and will not be made available to anyone other than the student.

3. Tutors are expected to be fully honest with EduMate NYC about their backgrounds, credentials, qualifications, abilities, and aptitudes in the context of their positions as volunteer tutors.

4. Tutors are expected to commit to working with their assigned student at least through June 27th, 2023 once matched.

5. Tutors may not share content with students that contains sexual images, vulgarity, graphic violence, threats, hate speech, or incitements to violence.

6. Tutors are not, to their knowledge, restricted by judicial decree, court order, or other legal restriction from interacting directly with minors.

7. Tutors may be terminated from the program at any time if they are shown to violate any given policy of EduMate NYC.

8. Tutors may be current high school sophomores, high school juniors, high school seniors, college students, or students enrolled in degree-granting professional schools or post-graduate programs. Those on voluntary leaves of absence from such programs, and those who completed a degree in spring 2020, or in 2021 or 2022 are also eligible. If you do not currently fall into any of these categories, please email us at edumatenyc@gmail.com to discuss other ways to get involved.

Student Terms of Service

I agree to abide by all the policies of EduMate NYC and assume full responsibility for all of my actions as a participant or as the legal guardian of a participant in this program. I recognize that if at any time I or my child break any policy of EduMate NYC, I or my child will be removed from the program and I or my child will assume total liability for any consequences of my or my child’s actions. In signing this form, I waive all legal liability. These policies include but are not limited to the following:

1. Students under the age of 18 must ask their parents or guardians to review this policy and accept all terms on their behalf. Students under the age of 18 can only participate in EduMate NYC with the consent of their parent or guardian.

2. Students consent to participate in virtual tutoring services conducted over video and/or phone.

3. Students will not meet in person with their tutors at any point in the EduMate NYC program and will not record any meeting without the express written permission of their legal guardians and their tutors, in accordance with state law. Any recordings abiding by these standards should not be made available to anyone other than the student recording and should be used only for students’ educational purposes.

4. Students are expected to be fully honest with the EduMate NYC program about their experiences with their tutors and should uphold proper standards of conduct in the context of their participation. They will report any concerns that they have about interactions with tutors or potential policy violations by tutors to EduMate NYC.

Parental Notice For the Collection, Use, and Disclosure of Personal Information

We are pleased and excited to welcome you to the EduMate NYC community.

The purpose of this notice is to seek your consent to your child’s participation in the tutoring services provided through EduMate NYC as well as to the collection and use of certain information about your child in order to provide those services.

In order to provide tutoring services, EduMate NYC will collect the following information about your child:

I agree to abide by all the policies of EduMate NYC, as listed on their website, and assume full responsibility for all of my actions as a student or as the legal guardian of a student in this program. I recognize that if at any time I or my child break any policy of EduMate NYC, I or my child will be removed from the program and I or my child will assume total liability for any consequences of my or my child’s actions. These policies include but are not limited to the following:

1. Students under the age of 18 must have a parent or guardian review this policy and accept all terms on their behalf. Students under the age of 18 can only participate in EduMate NYC with the consent of their parent or guardian.

2. Students consent to participate in virtual tutoring or other related services conducted over video and/or phone.

3. Students will not meet in person with their tutors or fellow students at any point in the EduMate NYC program and will not record any meetings.

4. Students will not use a private chat function to contact fellow students under any circumstances at any point in the EduMate NYC program.

5. Students understand that bullying or violence will result in their immediate dismissal from EduMate NYC activities. Students commit not to engage in violence or bullying. Our definition of bullying includes but is not limited to:

Verbal bullying: saying or writing mean things. Verbal bullying includes:

Teasing

Name-calling

Inappropriate sexual comments

Taunting

Threatening to cause harm

Social bullying: sometimes referred to as relational bullying, involves hurting someone’s reputation or relationships. Social bullying includes:

Leaving someone out on purpose

Telling other children not to be friends with someone

Spreading rumors about someone

Embarrassing someone in front of others

Physical bullying involves hurting a person’s body or possessions. Physical bullying includes:

Hitting/kicking/pinching

Spitting

Tripping/pushing

Taking or breaking someone’s things

Making mean or rude hand gestures

6. Students and parents are expected to be fully honest with the EduMate NYC program about their experiences with their tutors, and fellow students and should uphold proper standards of conduct in the context of their participation. Students and/or parents will report any concerns that they have about interactions with tutors or students, as well as any potential policy violations by tutors or students, to EduMate NYC.

7. Students understand that EduMate NYC reserves the right to require that they withdraw from EduMate NYC tutoring or summer programming at any time, for any reason, with or without cause.

8. Students understand that the views and opinions expressed during EduMate NYC programs reflect only the views and opinions of the speaker. They do not purport to reflect the views and opinions of EduMate NYC or its organizers. An individual’s participation in EduMate NYC programs does not represent an endorsement by EduMate NYC of that individual’s activities, views, or opinions.

9. Students understand that the information conveyed in EduMate NYC programs is provided for informational purposes only, and should not be construed as professional advice on any subject matter. You should not act or refrain from acting on the basis of any content included in EduMate NYC programs without seeking legal or other professional advice. EduMate NYC disclaims all liability for actions you take or fail to take based on any content on this site.

10. Students understand that EduMate NYC programs may include references to web sites or services operated by third parties. These web sites or services do not operate under the EduMate NYC Privacy Policy. EduMate NYC and its organizers are not responsible for the privacy practices or the content of such web sites or services, and EduMate NYC does not endorse such sites or services.

11. Students understand that EduMate NYC reserves the right to change the format of programs and events without prior notice. Further, EduMate NYC may impose restrictions on participants’ camera, microphone, and/or chat activity without prior notice.

12. In signing this Student Contract, I, as more fully set forth in the RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION (which shall control in the event of any conflict with this Student Contract), to the greatest extent provided by law, on behalf of myself and, if applicable, my child or children, release EduMate NYC and any of its coordinators, volunteer tutors, and students from all liability, costs and damages of any kind or nature whatsoever that may arise from or in any way relate to my or my child’s participation in EduMate NYC.

Waiver:

RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION


To the greatest extent provided by law:

I assume full responsibility for any risk of loss, property damage, or personal injury that may be sustained by me or my child/children as a result of or that is in any way related to my or my child’s/children’s participation in EduMate NYC.

I RELEASE FROM LIABILITY, WAIVE, DISCHARGE AND COVENANT NOT TO SUE EduMate NYC, and any of its coordinators, volunteer tutors, and students (the “RELEASEES”) for any liability, claim and/or cause of action arising out of or related to any loss, damage or injury, including death, arising out of or resulting from my or my child’s/children’s participation in EduMate NYC.

I also ASSUME THE RISKS of my participation and my child’s/children’s participation in EduMate NYC and agree to not hold the RELEASEES responsible for any loss, damage or injury of any kind or nature, that occurs as a result of or is in any way related to my or my child’s/children’s participation in EduMate NYC.

I further agree to INDEMNIFY AND HOLD HARMLESS the RELEASEES whether injury is caused by my or my child’s/children’s negligence, the negligence of the RELEASEES or the negligence of any third party.

I further agree that this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representatives, if I am deceased, and shall be deemed a RELEASE, WAIVER, DISCHARGE AND COVENANT NOT TO SUE the above-named RELEASEES. This RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION shall be construed in accordance with the laws of the State of New York.

By electronically signing this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION, I state that I have read, understand, and agree to the conditions set forth herein and that I sign this form freely and voluntarily on behalf of myself and my child or children.
